OBJECTIVES




To give exposure of a clear picture as to how a judicial proceeding takes place; elaboration on the process that involves examination in chief, cross examination and re-examination of the expert witness, the roles of each individual in the courtroom. 

Provide knowledge of judicial system, legal process and courtroom procedures

To raise awareness among healthcare workers of the possibility of receiving subpoena and how to get prepared for it.

To educate the healthcare workers of the importance of abiding to medicolegal practices and of its implications and consequences from breaching the practice

INTRODUCTION


Doctors and other healthcare workers may become involved with the law in the same way as any other private individual: they may be charged with a criminal offense or they may be sued through the civil court. For most, the nature of the work may result in that individual providing evidence that may subsequently be tested in court. For doctors are circumstances in which doctors become involved with the law simply because they have professional skills or experience. In these cases, the doctor (or other professional) may have one of two roles in relation to the court, either as a professional or as an expert witness, the delineation of which can sometimes overlap.

  A professional witness is one who gives factual evidence. This role is equivalent to a simple witness of an event but occurs when the doctor is providing factual medical evidence. On the other hand, an expert witness is one who expresses an opinion about medical facts. An expert will form an opinion, for instance about the cause of the fractured leg or the laceration. An expert will express an opinion about the cause of the epilepsy or the ability of an individual with angina to drive a passenger service vehicle. Before forming an opinion, an expert witness will ensure that the relevant facts about a case are made available to them and they may also wish to examine the patient. The role of an expert witness should be to give an impartial and unbiased assessment or interpretation of the evidence that they have been asked.

Predicated on the facts above, series of expert witness testimony is a course that runs simulation or enactment of a judicial proceeding. This course provides knowledge of the judicial system, legal process, and courtroom procedures. It serves as a platform to demonstrate the roles of various authorities in the legal system.  This session will be a kick start to expose professional and expert witnesses from various backgrounds whether being the paramedics, science officers, medical officers, specialists, and so on. The team that will be sharing the knowledge will be from the Ahmad Ibrahim Kulliyah of Law (AIKOL), IIUM.
